Rafiki Design and Renovations – Terms of Service

These Terms of Service (“Terms”) govern the use of services provided by Rafiki Design and Renovations (“the Company”, “we”, “us”, or “our”) to clients, including homeowners, landlords, property managers, and businesses engaging our services. By using or engaging our services, clients agree to comply with these Terms.


1. Scope of Services

1.1 Rafiki Design and Renovations provides professional services in:

  • Construction, including new builds, extensions, and structural modifications

  • Renovation and remodeling of residential, commercial, and industrial properties

  • Interior design, including furniture layout, fittings, and finishes

  • Landscaping, garden design, and maintenance

  • Plumbing and electrical installations, repairs, and maintenance

  • General maintenance, repair services, and consultancy

1.2 Services are offered nationwide in Kenya and may be customized per client requirements.

1.3 The Company reserves the right to refuse services that:

  • Are illegal or unsafe

  • Conflict with the Company’s values or capabilities

  • Violate local building codes or regulations


2. Agreement and Contractual Terms

2.1 Engagement with the Company begins upon:

  • Signing a work contract or service agreement

  • Submission of a Work Service Card or online request form

  • Confirmation of project acceptance by the Company

2.2 All projects are governed by:

  • These Terms of Service

  • Service contracts signed by the Client and Company

  • Work Service Cards specifying scope, cost, and timelines

2.3 The Company may require:

  • Payment of a deposit or advance before commencement of work

  • Written approval of designs, plans, or project specifications

2.4 Clients agree to provide:

  • Accurate information about project requirements

  • Access to the site as necessary for service delivery

  • Timely approvals for design, materials, and project milestones


3. Service Requests and Estimates

3.1 Clients may request services through:

  • In-person consultations

  • Phone, email, or messaging apps

  • Online forms on the Company’s website

3.2 The Company will provide estimates based on:

  • Scope of work

  • Materials required

  • Labor and subcontractor costs

  • Timeframe for completion

3.3 Estimates are valid for 30 days unless otherwise stated.

3.4 Final pricing is confirmed after site inspection, design approval, and specification review.


4. Payments and Billing

4.1 Payment terms are agreed per project and may include:

  • Deposit prior to work commencement

  • Milestone payments as work progresses

  • Final payment upon project completion and approval

4.2 Payments can be made via:

  • Bank transfer

  • Mobile money (M-Pesa, Airtel Money)

  • Cash or cheque

4.3 Late payments may incur additional charges as specified in the contract.

4.4 Refunds are governed by the Rafiki Design and Renovations Refund Policy.


5. Work Standards and Completion

5.1 All work is performed in accordance with:

  • Accepted industry standards

  • Project specifications

  • Applicable local laws, building codes, and safety regulations

5.2 The Company reserves the right to:

  • Inspect work at any stage

  • Require revisions or corrections if work does not meet quality standards

  • Halt work if unsafe conditions are identified

5.3 Work completion is deemed when:

  • Project milestones are fulfilled

  • Client inspection is approved

  • Final invoice is issued

5.4 The Company is not liable for delays caused by:

  • Force majeure (natural disasters, extreme weather, civil unrest)

  • Client’s failure to provide access or approvals

  • Supply chain or material shortages beyond the Company’s control


6. Client Obligations

6.1 Clients agree to:

  • Provide accurate information, site access, and approvals

  • Ensure timely payments per contract terms

  • Follow advice and instructions regarding site safety and material handling

6.2 Clients must not:

  • Interfere with project execution

  • Provide misleading information

  • Engage subcontractors on the project without prior written consent

6.3 Breach of client obligations may result in:

  • Delays

  • Suspension of work

  • Termination of the agreement


7. Independent Contractor and Subcontracting

7.1 Rafiki Design and Renovations may engage:

  • Freelance technicians, subcontractors, or specialists

  • Independent contractors to perform specific tasks

7.2 These individuals are not employees of the Company. The Company assumes responsibility for the coordination of all contracted services.

7.3 Clients may not hold the Company responsible for actions of subcontractors outside the scope of agreed services, unless negligent supervision by the Company is proven.


8. Materials, Equipment, and Tools

8.1 The Company may supply materials, tools, or equipment necessary for service delivery.

8.2 Clients are responsible for:

  • Ensuring site access for delivery

  • Protecting client-supplied materials or equipment

8.3 Any damage to client property during service execution is managed according to the contract terms.

8.4 Clients acknowledge that some materials are custom-made or non-returnable.


9. Safety and Compliance

9.1 Rafiki Design and Renovations follows strict safety protocols to comply with:

  • Kenyan Occupational Safety and Health Act

  • Building codes and industry best practices

9.2 Clients must:

  • Ensure safe access to work areas

  • Comply with safety instructions issued by Company personnel

9.3 The Company is not liable for accidents caused by client negligence or third-party interference.


10. Liability and Indemnification

10.1 The Company is liable only for damages resulting directly from:

  • Negligence

  • Breach of contract

  • Failure to meet agreed specifications

10.2 Clients agree to indemnify the Company against:

  • Losses from client-supplied incorrect information

  • Third-party claims due to client negligence or misuse

  • Legal costs resulting from disputes outside the Company’s control

10.3 The Company is not liable for:

  • Indirect, consequential, or incidental damages

  • Loss of revenue or property not under the Company’s direct control


11. Intellectual Property

11.1 All designs, plans, drawings, and digital content created by Rafiki Design and Renovations remain the property of the Company, unless otherwise specified in the contract.

11.2 Clients may use designs only for the purpose of the contracted project.

11.3 Unauthorized use, reproduction, or distribution of designs is prohibited.


12. Termination

12.1 The Company may terminate services if:

  • Client breaches payment or contract obligations

  • Unsafe conditions are created by the client

  • Project scope changes beyond the Company’s capacity without agreement

12.2 Clients may terminate services by:

  • Submitting written notice

  • Paying for work completed and materials purchased up to termination date

12.3 Termination does not affect the Company’s right to recover costs for completed work.


13. Dispute Resolution

13.1 The Company seeks to resolve disputes amicably through:

  • Discussion and negotiation

  • Mediation

13.2 If disputes cannot be resolved, they may be referred to Kenyan courts in accordance with applicable laws.


14. Privacy and Data Protection

14.1 Rafiki Design and Renovations collects and processes personal information in accordance with the Privacy Policy, including:

  • Client names, contacts, and payment information

  • Project specifications and site documentation

  • Communication history and feedback

14.2 Data is stored securely and used only for legitimate service purposes.

14.3 Clients have rights to access, correct, or request deletion of their personal information as outlined in the Privacy Policy.


15. Marketing and Communication

15.1 By engaging our services, clients may receive communications regarding:

  • Project updates

  • Service promotions

  • Company news

15.2 Clients may opt out of marketing communications at any time without affecting service delivery.


16. Changes to Terms of Service

16.1 The Company reserves the right to modify these Terms at any time.

16.2 Changes will be communicated via:

  • Company website

  • Email notifications

  • Updates in service contracts

16.3 Continued engagement with the Company constitutes acceptance of updated Terms.


17. Force Majeure

17.1 The Company is not liable for delays or non-performance caused by:

  • Natural disasters, extreme weather, or public health emergencies

  • Civil unrest, strikes, or government actions

  • Supply chain disruptions beyond the Company’s control

17.2 Clients will be notified promptly in case of force majeure affecting service delivery.


18. Governing Law

18.1 These Terms are governed by the laws of Kenya.

18.2 All disputes arising under or related to these Terms are subject to the jurisdiction of Kenyan courts.
